Whither Jack Rabbit Marine?

August 14th, 2008 · by Tim Flanagan, Managing Editor

JackRabbitMarine_LogoJackRabbit Marine’s website seems to be down, and their blog, Ask Jack Rabbit, is just…gone!

Anybody know what’s up? I’ve sent an email to Peter James of Ask Jack Rabbit. Until I hear something authoritative, though, I’m stumped.

I have also had no response from Jack Rabbit Marine for weeks. Unfortunately for me it involves the status of an expensive order that has been paid for.
With no response, no email, no website and an empty eBay site, one wonders what is happening.
Hopefully all is well and will be resolved shortly. I’m hoping not to have to deal with what seemed to be a reputable business failing in the middle of receiving an order.

Darren, same here. My husband and I have placed an order of significant value with them a little while ago as well. We’ve been trying to contact Jack Rabbit Marine for weeks now to enquire about the status, but just like you, no response to emails and phone calls remain unanswered. In the meantime we’ve reported the case to the local Stamford Police Department (http://www.cityofstamford.org/content/25/52/140/214/216/367/3822/3828/3830/default.aspx) and I suggest you do the same. Hopefully, if we organise ourselves, we’ll be able to recover part or all of our hard-earned dollars.

Everyone, we found this email from Peter James, owner of Jack Rabbit Marine, in our mailbox this morning:

JackRabbit has closed and is filing for bankruptcy. I’m sorry that you got caught up in this mess. My understanding of the process is that the court appoints a trustee who is responsible for liquidating the assets of the company and reimbursing the creditors. Your contact information and the amount owed will be provided to the court as part of the filing. If you are not made whole by the trustee, I consider it my personal responsibility to make sure that eventually the full amount owed is returned to you.

This is so sad and a loss of a great resource for boaters. I hope that Peter can at least bring the askjackrabbit content back online for reference if nothing else. Even if he never makes another post, I am sure it will pay for itself with Google Ad revenue. I’m sure he could get hosting for it for less than $100/yr.

I have to report the same about Jackrabbit Marine. I ordered a transducer a couple weeks ago, and they took $675.00 from me . You would think that if someone was going to file bankruptcy they would not have taken any orders/money. I had to laugh, two weeks ago they sent me an email that my transducer was going to be sent out, have I received, of course not. This jerk,Peter James is no different then a thug on the streets and belongs in jail.

I also have to report the same about Jack Rabbit. I placed an order from their ebay site on August 10, and paid with Paypal. It was for $1135.00.

I have tried to call, email, and contact the seller through Ebay.

I just filed my claim today with Paypal, according the the docs, I am protected as a buyer going through Ebay and Paypal, so I should be getting my money back.

It would have nice it they company had taken their auctions offline before pulling this stunt.

I also have a large purchase with JackRabbit Marine, already paid for, and they have not yet shipped the product. They are unreachable by email or phone. They haven’t sent me any email and haven’t replied to my many attempts to find out about the status of my order.

If it’s true that they’re going bankrupt, it’s a real shame. How can someone take the money and just run away? Shame.

I wrote Peter his email address, and got this reply.

He can be reached @ jackrabbitmarine@gmx.com

“I understand your displeasure with the situation. As a businessman yourself, I hope that you also understand that this situation is not something that I went into willingly, and that I have not myself in any way profited from the failure of the company. In fact I will have lost a large investment and many years of effort that was put into Jack Rabbit. The bankruptcy court will appoint a trustee who will liquidate the assets of the company and use those assets to reimburse the creditors including yourself. You have my personal guarantee that you will be reimbursed in full if the court does not do so.

I see that you have opened an issue with PayPal requesting a refund. That is not possible at present until the bankruptcy process is completed, which may take a few months. I would ask that you please close that issue with PayPal for the moment until the situation with the court can be resolved. You can always re-open it later. Having the PayPal account blocked does not help me resolve the situation, and if that should cause me to be forced into personal bankruptcy as a result, my ability to repay creditors such as yourself will disappear.
    Thanks for your understanding
    Peter James”

Him and I have been talking back and forth about this situation, so at least we are in communications. He sounds like a sincere enough guy, and I want to work things out with him, but on the other hand I dont know him from Adam, and if I close my paypal claim I will lose all my recourse of ever getting my money back… so right now I am on the fence with this… and at this point, am leaving the claim open until I am convinced otherwise.

Scott, have you been talking to Peter James VIA telephone? It is amazing that he has not contacted any of the other people who he ripped off. My suggestion is that I would not close your claim against him. Like I said, if this guy was so sincere, he would not have taken any orders/money from any of his customers at the time he was going into to bankruptcy. It is a shame we had to learn that he filed bankruptcy by reading the forums.

I’m no bankruptcy attorney, but I’m pretty sure some misconceptions about how that process works are influencing some of the comments here.

For instance, I’m not sure a business can change its operating protocols in anticipation of filing for bankruptcy. In fact, they may be required NOT to change their operations. It would be nice to hear from somebody who understands the process better.

  • Scott Swenka // Aug 29, 2008 at 6:39 am

Hi William. No we never talked via phone, just email. I filed my claim on Aug 18 with Paypal, and today Aug 29 I had an email from Paypal advising me they recovered my money of $1135.00, so I checked my account, and it was there, the entire amount.

So I am glad that I did not close the claim.

I hope others are as lucky as I was with Paypal…. I would venture to guess that anyone who paid with credit card, will also be made whole again.

    Scott,

Great that you used PayPal. PayPal has protected me in the past as well.
I think that it is shameful that Jackrabbit tried to get you to drop the PayPal claim. Is he that desperate for $1135.?

Unfortunately the ¨askjackrabbit¨ information will probably be lost as well as the funds of those who paid him by other means than PayPal.

In my 45 years of boating I have seen this happen more times than I care to remember.

    Fair winds and following seas,

    Igeaux
